The name Hague Convention Lawyers has relation with our nowadays activity due to the fact law firms work with international adoptions and international kidnapping.  There are two conventions “The Hague Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption” (Hague Adoption Convention) protects children and their families against the risks of illegal, irregular, premature or ill-prepared adoptions abroad and “The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction” is a multilateral treaty, which seeks to protect children from the harmful effects of abduction and retention across international boundaries by providing a procedure to bring about their prompt return.

The law firms have experience and probate background in both areas.  Marco Aurelio Gerace has the Brazilian and Italian citizenship and Fabiana Marcela Quaini has the Italian and Argentine citizenship. Dilia Leticia Mera Jorge has Domenican citizenship.

The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction has 93 Contracting States, las update was Dec. 16, 2015.  Our law firms returned home children kidnapped in representation of the left behind parents LBPs. 

We worked in cases with United States, England, France, Germany, Italy, Spain, Colombia, Peru, Chile, Uruguay, Bolivia, Romania, Mexico, China, Argentina, Dominican Republic and Brazil.

We also have fellows specialized in Hague cases around the world.

A quick decision is the key in this kind of process where there are very few things to discuss and a lot of things to be done. It is not about who is the best parent, but if there is a Hague case or not, and whether there are exceptions to avoid the return of the children.

Whenever a restitution petition is misconceived, then it is very difficult to correct it. Therefore the choice of an expert on kidnapping cases is critical to ensure the best representation to achieve the objectives of the Hague Convention.

The Hague Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption is another focus in our daily work.

We follow and take care of all the files given to us by the agency.

We also have a staff to receive and welcome the foreign families in Brazil in the final step to share and leave with their adoptive son.  We have psychologists preparing their feedback when we propose a child to a family; we do our best for children and families. Those little details make the big difference. Our law firm is also very close to the CEJAI of San Pablo.

The Hague Convention of 29 May 1993 on Protection of Children and Cooperation in Respect of Intercountry Adoption entered into force on 1 March 2007.
We take care of approvals
of the foreign agencies in our country in order to work with international adoptions. In the Dominican Republic, the Central Authority is  "Consejo Nacional para la Niñez y la Adolecencia" "CONANI". After the prospective adoptive parents receive and accept the referral of a child, CONANI reviews the prospective adoptive parents' file for required documents and, if satisfied, issues a Certificate of Suitability. Dominican adoption law is governed by the Dominican Code of Fundamental Protection and Rights for Children and Adolescents, Law 136-03, Articles 111-167. The Dominican Court of Minors receives the formal, legal application for adoption. If the application is approved, the Court issues a Final Order of Adoption. We take care about the administrative and court process.

The Hague Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption was not signed by Argentina. 

We assist Italian families living in Argentina and out of Italy for international adoptions. Italian system of law allows Italian families living out of Italy to adopt internationally as if they live in Italy.

Italian-Argentine families can adopt now in in Brazil, Haiti, Poland, Bulgaria, Colombia, and Bolivia.  We are proud to help Italian families in Argentina to adopt internationally.

Petitions in the Inter Amercian Commission of Human Rights

We assist you in filing a petition before the Inter-American Commission on Human Rights, as victim of human rights violations.  The Commission investigates the situation and can make recommendations to the State responsible to restore the enjoyment of rights whenever possible, to prevent a recurrence of similar events, to investigate the facts and to make reparations.

We filed the petition against Brazil in kidnapping cases PETITION 897-04 ADMISSIBILITY. ALEJANDRO DANIEL ESTEVE AND SONS BRAZIL November 2, 2011.  On September 14, 2004, the Inter-American Commission on Human Rights (hereinafter, “the Inter-American Commission” or “the IACHR”) received a petition lodged by Alejandro Daniel Esteve on behalf of himself and his minor children Dan and Paul (hereinafter “the alleged victims”) against the Federative Republic of Brazil (hereinafter, “Brazil” or “the State”) for the alleged illegal retention of both of his children in Brazilian territory and for alleged due process violations during the trial on their return. Subsequently, attorney Fabiana Marcela Quaini (hereinafter, “the petitioner”) took over representation of the case before the IACHR.

We also filed petitions against Argentina, Petition 1212/2012 Quintana v. Argentina and in the European Court of Human Rights. Ferrari v. Rumania ECHR LE4.1aR BB / tsz. 04/10/2013. Today we are in process more of eight petitions.

Marco Aurelio Gerace, has license to work in any place in Brazil, he is member of the International Academy of Family Lawyers IAFL and is listed in Reunite. Dilia Leticia Mera Jorge, has license to work in the whole country of Dominican Republic, she is fellow of the IAFL, she was surrogate Judge and she is called as expert in different Hague conventions. Fabiana Quaini has license to work in Buenos Aires city, Province of Buenos Aires and Mendoza in Argentina. She is also member of the IAFL, listed in Reunite, member of the American Academy of Assisted Reproductive Technology  AAARTA.
